The Protection of Plant Varieties and Farmers Rights Act, 2001 :

✒️It was enacted on 30th october 2001 and came into force on 11th november 2005, to provide for the establishment of an effective system for protection of plant varieties, the rights of farmers and plant breeders and to encourage the development of new varieties of plants.
  • History of PPVFRA: The PPVFRA was enacted in 2001 after engaging debates were held in the country on how intellectual property rights should be introduced in Indian agriculture after the country joined the World Trade Organisation in 1995 and agreed to implement the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).The choice before India was to either enact a law that protected the interests of farming communities or to accept the framework of plant breeders’ rights given by the International Union for Protection of New Plant Varieties (UPOV Convention). The latter option was rejected primarily because the current version of UPOV, which was adopted in 1991, denies the farmers the freedom to reuse farm-saved seeds and to exchange them with their neighbours.Therefore, in the PPVFRA, India introduced a chapter on Farmers’ Rights, which has three legs:one, farmers are recognised as plant breeders and they can register their varieties;two, farmers engaged in the conservation of genetic resources of landraces and wild relatives of economic plants and their improvement through selection and preservation are recognised and rewarded; and,three, protecting the traditional practices of the farmers of saving seeds from one harvest and using the saved seeds either for sowing for their next harvest or sharing them with their farm neighbours.
  • Objectives of the PPV & FR Act, 2001: To establish an effective system for the protection of plant varieties, the rights of farmers and plant breeders and to encourage the development of new varieties of plants, To recognize and protect the rights of farmers in respect of their contributions made at any time in conserving, improving and making available plant genetic resources for the development of new plant varieties, To accelerate agricultural development in the country, protect plant breeders’ rights; stimulate investment for research and development both in public & private sector for the development new of plant varieties, Facilitate the growth of seed industry in the country which will ensure the availability of high quality seeds and planting material to the farmers.
  • Breeders’ Rights : Breeders will have exclusive rights to produce, sell, market, distribute, import or export the protected variety. Breeder can appoint agent/ licensee and may exercise for civil remedy in case of infringement of rights.
  • Researchers’ Rights : Researcher can use any of the registered variety under the Act for conducting experiment or research. This includes the use of a variety as an initial source of variety for the purpose of developing another variety but repeated use needs prior permission of the registered breeder.
  • Farmers’ Rights: A farmer who has evolved or developed a new variety is entitled for registration and protection in like manner as a breeder of a variety;
  • Farmers variety can also be registered as an extant variety;
  • A farmer can save, use, sow, re-sow, exchange, share or sell his farm produce including seed of a variety protected under the PPV&FR Act, 2001 in the same manner as he was entitled before the coming into force of this Act provided farmer shall not be entitled to sell branded seed of a variety protected under the PPV&FR Act, 2001;
  • Farmers are eligible for recognition and rewards for the conservation of Plant Genetic Resources of land races and wild relatives of economic plants;
  • There is also a provision for compensation to the farmers for non-performance of variety under Section 39 (2) of the Act, 2001 and
  • Farmer shall not be liable to pay any fee in any proceeding before the Authority or Registrar or the Tribunal or the High Court under the Act.

The Merchant Shipping Act, 1958 :

✒️It was enacted on 30th October 1958 & came into force on 15th December 1958, to foster the development and ensure the efficient maintenance of an Indian mercantile marine in a manner best suited to serve the national interests and for that purpose to establish a National Shipping Board to provide for the registration, certification, safety and security of Indian ships and generally to amend and consolidate the law relating to merchant shipping.

เฎชเฎšுเฎฎ்เฎชொเฎฉ் เฎฎுเฎค்เฎคுเฎฐாเฎฎเฎฒிเฎ™்เฎ•เฎค் เฎคேเฎตเฎฐ் - Pasumpon Muthuramalinga Thevar, Politician :

✒️Freedom fighter, great orator, spiritualist Pasumpon Muthuramalinga Thevar was born on 30th October, 1908 in Pasumpon village of Ramnad district. He learned Tamil grammar and literature on his own initiative. In the year 1933, the opening ceremony of the library started in the name of Vivekananda took place in Sayalgudi next to Muthukulathur. As the chief speaker did not come, he was invited to speak. This is his first time on stage. But he spoke about Vivekananda's philosophies for 3 hours like a flood and won praise. He left the Congress in 1948 and joined the Forward Bloc Party. He started a weekly magazine 'Netaji'. He won the election and served as a member of the Madras Provincial Legislative Assembly. Muthuramalinga Thevar, who fought for freedom, died on 29th October, 1963 due to ill health.

เฎนோเฎฎி เฎœเฎนாเฎ™்เฎ•ீเฎฐ் เฎชாเฎชா - Homi Jehangir Bhabha, Indian Nuclear Physicist :

✒️Homi Jehangir Bhabha, the father of Indian Atomic Science, was born on October 30, 1909 in Mumbai. After completing his studies in 1932, he continued his research at Cambridge University. In 1934 he received his Ph.D. He researched quantum theory with Niels Bohr and cosmic rays with Walter Heinrich Heitler. He was awarded Padma Bhushan, India's highest award in 1954. In order to commemorate his rare contribution forever, Mumbai Atomic Research Center was named Bhabha Atomic Research Center from 1967. He was instrumental in setting up the Atomic Energy Commission and the Department of Atomic Energy. He became the first Chairman of the Atomic Energy Commission of India. Due to this, India's first nuclear reactor started operating in 1956 at Trombay near Mumbai. It also holds the distinction of being Asia's first nuclear reactor. Homi Jahangir Bhaba passed away on 24th January 1966.
